Generally, taking photos of military aircraft from public property outside a base is not inherently illegal in the US. However, it is a FEDERAL CRIME (18 USC § 795) to photograph designated vital defense installations or equipment. Key restrictions include avoiding photography of base gates, security checkpoints, sensitive areas, aircraft, and not trespassing.

While public photography is generally allowed, taking photos of specific 'sensitive' military aircraft or infrastructure, even from off-base, can lead to charges. Always be prepared to identify yourself and comply with security personnel requests.

If this Chinese national was not inside the military base and was taking pictures from the outside, is that illegal??? That person is only 21, and a college student. Was he recruited by Chinese intelligence before he left China at age 18, to attend college in the UK? If he is really an innocent tourist, will they still use the most harsh interpretation of the law to punish him?

I live near Camp Pendleton, and I often take picture of the area, especially when I am showing guests around. Since I never got authorization to take pictures near the base, am I breaking the law???

FYI, American media people are funded to write anti-China articles! Congress recently passed the “Countering the PRC Malign Influence Fund,”(H.R.1157 - Countering the PRC Malign Influence Fund Authorization Act of 2023 ) to the tune of $1.6 billion!!! This is a lot of money and media people have to spend that money. This is in addition to the 2013 Countering Foreign Propaganda and Disinformation Act (CFPDA) . Literally billions are spent to mud sling at China!

The effect of these propaganda efforts since the end of World War 2, was to instill in Americans a hate for Russians, communists, Muslims, Chinese and Iranians.
