Dear Martin Vickers MP

The Importance of Trial by Jury

I believe that Deputy Prime Minister David Lammy and Secretary of State for the Home Department Shabana Mahmood may be acting under a misapprehension regarding Constitutional rights of the people by using just Clause 40 of Magna Carta to propose major constitutional changes to the people's justice system.

I am writing to you as a constituent to express my deep concern about the ongoing pressures on the justice system and any policy proposals that may weaken or limit the right to trial by jury.

Trial by Jury is part of not only our Constitutional Rules under Magna Carta Clause 39, but also part of the ancient customs, practices and liberties of the English People under our Common Law mentioned in William and Mary's Bill of Rights 1688.

Clause 39 Magna Carta; "No free man is to be arrested, or imprisoned, or disseised, or outlawed, or exiled, or in any other way ruined, nor will we go against him or send against him, except by the lawful judgment of his peers or by the law of the land."

Clause 40 Magna Carta; "We will not sell, or deny, or delay right or justice to anyone."

ORIGINAL 1215 British Library: + (39) "No free man shall be seized or imprisoned, or stripped of his rights or possessions, or outlawed or exiled, or deprived of his standing in any way, nor will we proceed with force against him, or send others to do so, except by the lawful judgment of his equals or by the law of the land." + (40) "To no one will we sell, to no one deny or delay right or justice."

Quote from Bill of Rights 1688:

"And I do declare That no Foreign Prince, Person, Prelate, State or Potentate, hath or ought to have any Jurisdiction, Power, Superiority, Pre-eminence, or Authority Ecclesiastical Spiritual within this Realm So Help me God.

That the said Lords Spiritual and Temporal and the Commons being the two Houses of Parliament should continue to sit and with their Majesties Royal Concurrence make effectual Provision for the Settlement of the Religion Laws and Liberties of this Kingdom so that the same for the future might not be in danger again of being subverted.

To which the said Lords Spiritual and Temporal and Commons did agree and proceed to act accordingly.

Now in pursuance of the Premises the said Lords Spiritual and Temporal and Commons in Parliament assembled for the ratifying confirming and establishing the said Declaration and the Articles Clauses Matters and Things therein contained by the Force of a Law made in due Form by Authority of Parliament do pray that it may be declared and enacted That all and singular the Rights and Liberties asserted and claimed in the said Declaration are the true ancient and indubitable Rights and Liberties of the People of this Kingdom and so shall be esteemed allowed adjudged deemed and taken to be and that all and every the particulars aforesaid shall be firmly and strictly holden and observed as they are expressed in the said Declaration And all Officers and Ministers whatsoever shall serve their Majestys and their Successors according to the same in all times to come. "

Trial by jury has long been a cornerstone of justice in the United Kingdom. It stands as a vital safeguard against the misuse of state power by ensuring that ordinary citizens—rather than government officials—decide on matters of guilt or innocence. This system provides transparency, community involvement, and a crucial check on authority and can correct bad law. It embodies the principle that justice must not only be done but must be seen to be done.

Limiting or bypassing jury trials, whether through administrative measures, expanded judge-only trials, or procedural shortcuts, risks eroding public trust in the fairness and impartiality of the legal system. While efficiency and cost-saving are often cited as justifications, these cannot outweigh the importance of protecting fundamental rights that have been integral to British democracy for centuries.

I urge you to oppose any proposals that would reduce access to trial by jury and to advocate for policies that strengthen, rather than weaken, the right to a fair and public hearing by an impartial tribunal of one's peers, and I would respectfully suggest that the government restore all of the magistrates courts which were shut down contributing to the backlog.
