THE rights of migrants outweigh safety concerns of Epping locals, the Home Office argued yesterday in a case that threatens to collapse Labour’s asylum system.

Yvette Cooper fears an order shutting the hotel at the centre of anti-immigration protests sets a ‘dangerous precedent’ that will encourage similar litigation by other councils.

Lawyers for the Home Secretary warned that an injunction blocking asylum seekers from staying at The Bell Hotel could spark violent protests across the UK.

It came as the Government sought to appeal against a High Court order to remove asylum seekers from the building in Essex by September 12.

The Home Office told the Court of Appeal that it is in the ‘national interest’ to have migrants at the location as allowing a ban could have a ‘serious impact’ on the ability to house asylum seekers.

It came after Mr Justice Eyre last Tuesday ordered all 138 asylum seekers to be temporarily removed following legal action brought by Epping Forest District Council. Yesterday the Home Office and owners of The Bell asked the Court of Appeal to reconsider the judgment.

Home Office lawyers argued that Ms Cooper’s obligations to migrants under the European Convention on Human Rights (ECHR) trump those of the Epping council.

At the heart of her case is her statutory duty to prevent asylum seekers from becoming destitute....."
