This I believe is a mistaken notion that many seemed to have adopted as true, but that I think is dead wrong. If we accept that the Constitution is the "supreme law of the land", and which in fact is the case, then once any person is on U.S. soil that person is bound by and subject to all U.S. law, and which therefore also means that this person has all of the protections guaranteed to all persons under our Constitution.

If this were not the case and "non-Americans" did not have the protections afforded to citizens, then one could argue that coming from a foreign country that such a person would also not be subject to U.S. law and could therefore never be charged with what would otherwise be a crime by violating a U.S. law. And this of course is not true because as we all know, if you, regardless of where you come from, violate a U.S. law on U.S. soil you will be charged and prosecuted for the crime that you committed.

And as for what takes place off shore on foreign soil, that is another matter. But I tend to agree with the judge that agents for the U.S. government even while away and not on U.S. soil are bound by the Constitution because as stated in the posting, wherever the government goes lawfully and permanently, the Constitution goes with it.
