THE REAL FACTS OF THE IMPEACHMENT FIASCO

This monograph is directed to those who can think for themselves, look at the facts as they exist and apply logic and the law to the facts.

Then, We the People will begin to open the possibilities of re-establishing control over our public servants.

FACT 1. Acts in the Congressional House are official and certified public record.

FACT 2. All official government records are binding as fact on all government. No denial of the records possible.

FACT 3. It matters not whether the procedures and process in the circus hearings were in compliance with the law of due process or right to defend ones self. The only fact that matters is that the hearings happened.

FACT 4. The House voted to charge the President with allegations of wrong doing. It matters not that there is no jurisdiction to do so. No allegation of Treason, Bribery, High Crime or Misdemeanor = no jurisdiction to Impeach.

FACT 4. The Charge of Impeachment, fatally defective or not, is a Charge against the President in his operation of office of President. THIS IS THE ESSENTIAL FACT.

FACT 5. The House is DONE! The only authority the House holds is for making the Charge of Impeachment. Now a DONE deal. No further acts authorized to Constitution.

FACT 6. The Constitutional powers and mandatory duties requiring Trial are now triggered.

FACT 7. The Senate has no choice under the Constitution. TRIAL MUST BE HELD!

THE CONFUSIONS. The Senate is now in the very uncomfortable position as a JURY.
Jury trial is required for all charges against anyone for any reason. BILL OF RIGHTS!

Amendment VII controls. The only escape from jury trial is to show the value of the Presidents Office is less than twenty dollars, or, the Constitution is not a common law contract binding all officers under Article VI oath clause.

Accused in an Impeachment proceedings is alleged to have committed felonies of Treason, Bribery, High Crime or Misdemeanor. This triggers the Bill of Rights. Amendment VI controls. Impartial jury, Confrontation with accusers and witnesses, compulsion of witnesses presence, counsel.

Most important is the submission for record of all documents, facts of public record, and other evidence leading to facts, both public and private clearing the accused. Also triggered is Amendment V, Due Process, notice and opportunity to respond.

In short, the procedure to Clear My Good Name!!!

The fatally defective Impeachment charging instrument and vote to Impeach are essentially a charging document. The House acted in capacity like a grand jury finding an indictment.

It matters not that the indictment is defective. The fact that charges affecting Donald Trump and thereby our office of President challenging the executive branch powers and authorities, is all that counts.

Now, our Senate, is placed in the position to show every American whether We the People live with a government controlled by the Rule of Law or not!

If the Senate provides the President and the Executive Branch with full access to Amendments IV, V, VI, VII, the Rule of Law will be in evidence.

If the Senate, for any reason whatsoever, under any circumstance whatsoever, denies Donald Trump access to and full protection of the controlling Bill of Rights, We the People, will be duly informed our Republic takes second place to Divided Loyalty posers in our public servants offices.

All the other discussions revolving around the Senate and House acts or omissions become irrelevant under these facts. Why so much argument and conjecture surrounding the Impeachment circus? Perhaps deception and confusion sold for a private agenda and self preservation?

The Rule of Law is on Trial before the People the ultimate jurors controlling the Court of Public Opinion.

The parallels between the current circumstance and July 3, 1776 are overwhelming.

What do We the People Choose?

What will We do if the Senate tells us there is no law by denying our President the absolute right to clear his name and prosecute those in the House by exposing their misdeeds through a jury trial?

We live in interesting times.

I for one do not like being treated as human capital to be lied to and regulated by posers in public office. How about you?
