My understanding is that an Executive Order _does_ "become law" but is applicable only to the Executive Branch.

This means EOs can clarify or fine-tune things Congress has ceded to the Executive but cannot arrogate to the Executive any powers not so ceded. Even then, EOs are subject to judicial review; and presumably Congress could take back any powers it had previously ceded.

So on this issue the question should be, "_Has_ Congress ceded sufficient power to the Executive Branch to logically support the imagined and feared actions against the American people, and in such a way that Posse Comitatus would be overridden?"

I don't have the answer to that, but the whole "Stroke of a pen, make new law" idea has to be viewed in that light.
