Yesterday about 1 pm, we posted a story that was based off a Fox News story that President Obama might be able to singlehandly appoint a replacement for Supreme Court Justice Antonin Scalia because both the House and Senate are in recess for the President’s Day holiday today.

Although it is true that both houses of Congress are adjourned until next week, what the Fox piece missed - and I failed to catch - was that the U.S. Constitution is very specific in regards to how long a recess appointment may endure:

Article 2, Section 2
“The President shall have power to fill up all vacancies that may happen during the recess of the Senate, by granting commissions which shall expire at the end of their next session.”
Supreme Court judges are appointed for life.

So yes, he could appoint a temporary Supreme Court justice, however there would be several downsides to this.

1. Senator Orin Hatch said yesterday that the Senate has tools to prevent this.

2. The other 8 justices on the Supreme Court may simply reject a new temporary member; and

3. This would be seen as merely another Obama power grab and bring on reams of negative publicity raiding down on his languishing administration that would certainly spill over onto Democrats in general.

Bottom line; it’s NOT going to happen, so I took the story down.

Since there is now controversy over the way Judge Scalia died, the removal of the previous video had to be explained.

What is the controversy?

According to the Houston Chronicle in a story written by John MacCormack and updated at 2:40 pm yesterday, Feb. 14th, the resort owner, John Poindexter, knocked on Judge Scalia’s door at 8:30 am when he did not appear for breakfast.

When Scalia did not answer the door, Poindexter assumed he was still asleep.

Three hours later, Poindexter returned after an outing and, finding that the judge had still not appeared, entered his room:

“We discovered the judge in bed, a pillow over his head. His bedclothes were unwrinkled,” said Poindexter.

Poindexter said the body was cold and the judge had no pulse. He called a local doctor and concluded resuscitation would have been futile.

According to the newspaper report:

“He then contacted federal authorities, at first encountering a series of answering services because he was calling on a weekend.”

Scalia’s death has subsequently been attributed to “natural causes”, specifically a heart attack.

However, the death will forever be shrouded in mystery because who - in the midst of a heart attack - would decide:

“Oh, my chest hurts. What I need is to put a pillow over my nose and mouth to restrict my ability to breath.”

It’s such a silly assumption that even the CBS News report on the death posted at 22:58 last night highlighted in red that an:
“autopsy was not necessary.”

Well, it certainly IS necessary to determine whether the judge died of asphyxiation or a heart attack.

Until that is done by a panel of recognized forensic pathologists, murder conspiracy theories will continue to circulate – and for legitimate reasons.

In addition, there are some great pictures on the Houston Chronicle site, which I will not display on this story because the photos have now been bought by Getty Images and Getty is very hard line about copyright infringement.

So I will post them in my next report.

The most interesting one is an actual picture of the bed and the pillows in the room taken just hours after the Judge’s body was removed to be flown home to Virginia.

Still Report #620 - No Conspiracy in Scalia's Death

The death of Supreme Court Judge Antonin Scalia has disturbed me all day.

In the late afternoon, someone sent in a comment that the owner of the Cibolo Creek Ranch, where Judge Scalia died – John Poindexter – was the:

“… disgraced former head of NSA caught up in the IRAN CONTRA affair.”

“Poindexter was convicted on April 7, 1990, of five counts of lying to Congress and obstructing the Congressional committees… .”

That was too juicy a tidbit to pass up. I dove into research.

First problem:

This is the best picture of John B. Poindexter – the owner of the Ranch.

Does this guy look like this guy?

This is the former head of the NSA. No.

They are different people.

Ranch Owner John Poindexter is a good guy.

Yeah, he’s a Democrat, but he’s spent a good deal of his money preserving the historical assets of that 30,000 acre piece of land.

He’s also bought land around Williamsburg, VA. for preservation.

He paid for his freedom the hard way, the right way.

In 1966 he volunteered for two tours in Vietnam where we won many decorations, including a silver star, two bronze stars, and two purple hearts.

He made his money at Smith Barney.

Now he owns the company that makes the large vans for FedEx and UPS.

So tonight, Fox News Supreme Court reporter, Shannon Bream revealed that she interviewed Poindexter today --- and more.

So, it’s unfortunate that no autopsy was done, but those were the wishes of the family and so to me, this case is closed.

I work in (none of your business) for regulatory purposes, and have been called out to inspect areas half a day's drive away that have little-to-no problems - just for the clean bill of health.

I think examining the body of a Supreme Court Judge is slightly more important.

Having said that, I hope this is just incompetence and not a conspiracy.

Those things are hard to shake - if only in the public view.

Sorry Bill I will never believe that Scalia wasnt murdered.

Obama has too much to gain by Scalias removal.

I have problems that regardless of local laws that when a SCOTUS justice dies in suspicious circumstances, that no autopsy was performed.

Bill please look into the report that the gray hearse which left during daylight, was a decoy.

A report of the body being moved at midnight in a van, has been made.

Before you give the rubber stamp to the main stream, there is more here than what this report has aired.

Also, I am unaware of any video statements from the Scalia family, other than third party sources.

Bill, my dad passed in his sleep, on a computer chair with one leg up on a stool.

He too had a heart attack, and when he was discovered, no one could tell he was not asleep.

In fact mom tried to wake him for his morning coffee.

The judge did not put a pillow over his own face!

That is total crap.

As for the Autopsy, isn't it the LAW that if you pass not under a doctors care, for an ailment which would be fatal, like my dad saw his doctor the day before, and no autopsy was required by the county.

A Supreme Court Judge, dies without prior care for a potentially fatal disease, and no autopsy is demanded?

Sounds like the act of the same crew who tossed UBL's body off the ship at sea.

This has the odor of a Clinton or Obama hit!

Now to make a county medical examiner not follow the law, and the marshals even did not bother to go see his body, and pronounced him dead over the phone, reeks of cover up.

Deaths requiring INQUEST, means an investigation into the cause and circumstances of the death of a person, and a determination made with or without a formal court hearing as to whether the death was caused by an unlawful act or omission.

Deaths requiring an inquest.

#3 The body or body part of a person is found, the circumstances of death are UNKNOWN.

#6 the person dies WITHOUT being attended by a physician.

Clearly this STATUTE was not carried out by the JOP in TX., especially in light Mr. Scalia's status in the government.

Being so 'disgusted with the hullabaloo' being raised about this incident, shows a defining disconnect between knowledge and wisdom.

Whether Scalia was 'hard right' or 'hard left' is not the issue.

Whether Scalia was a good man in your eyes, or a bad man in your eyes, is not the issue.

The issue is the MURDER of a Supreme Court Judge by an opposing political viewpoint - STRICTLY BECAUSE of that opposing political viewpoint.

That IS a big deal, because it is ADMITTING that LAWLESSNESS RULES, CHAOS TRIUMPHS - and there are NO RULES LEFT.

If this is allowed to be swept under the rug, like all the other multitudes of criminal acts committed by these cretins from hell, it will be obvious that America has indeed lost its soul, and there is no use in even attempting to disseminate alternative opinions.
