Unconstitutional? When has that ever stopped the federal government from exerting their force upon the states and citizens by claiming the right to do so under the Supremacy Clause of the U.S. Constitution? If the federal government stuck to obeying the rule of law and abiding by the Constitution many of today's laws would not exist. For example there would be no anti-gun laws as the Constitution has never been amended to alter or change any part of the Second Amendment and so it stands as written... in plain simple language it says "Shall not be infringed". It took a constitutional amendment to ban alcohol and introduce Prohibition (the 18th Amendment) and when that was found to have been a big mistake it took another constitutional amendment (the 21st Amendment) to undo the mistake of Prohibition. Neither acts of Congress nor presidential executive orders can change what is in the Constitution. Changes can only be lawfully accomplished via the amendment process. But that has never stopped them because they believe they are "supreme". However if read correctly, Article VI, Clause 2 of the Constitution has a condition attached to it. The laws of the United States are the supreme law of the land, but only when they are "in pursuance of the Constitution".
Article VI, Clause 2:
This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.
Define "pursuance" - the following or carrying out of some plan, course, injunction, or the like.
It's actually pretty simple. The rule of law is that the Constitution is the supreme law of the land and that all laws must conform and be in harmony with the Constitution.
Legal and lawful are two different things...
They can make almost anything illegal... but is it lawful?
