(National Sentinel) Sanity: Though President Barack Obama implemented the Deferred Action on Childhood Arrivals (DACA) policy via executive order — which most constitutional experts said he had no authority to do because he was changing existing immigration law — POTUS Donald Trump has had a difficult time repealing that order through his own executive action.

Now, however, a federal judge has handed his administration its first real DACA victory after reversing an earlier Aug. 3 ruling.

The Western Journal reported:

U.S. District Judge John Bates said the government does not have to accept new Deferred Action for Childhood Arrivals requests, on Friday, going back on his initial order from Aug. 3.

Illegal immigrants who were brought over as children, known as “Dreamers,” can renew their DACA applications, but no new requests will be processed, The Associated Press reported.

Bates initially ordered U.S. Citizenship and Immigration Services to restart DACA by Aug. 23.

USCIS warned restarting the program would force the agency to look at the uptick of roughly 50,000 new DACA applications instead of focusing on legal immigrant and guest worker applications, The Washington Times reported on Aug. 15.

Opponents of illegal immigration — and supporters of the president — applauded the ruling.

In addition, Bates ordered special protections for current DACA recipients delayed. One of those is advanced parole, allowing recipients to travel outside the U.S. and then re-enter the country, which is sometimes a path to citizenship.

His ruling comes as Texas considers completely getting rid of DACA.

The Lone Star State and a half-dozen others are seeking to make the entire program illegal — since it was never constitutional to begin with.

Texas Attorney General Ken Paxton, a Republican, argued that the implementation of DACA was a federal overreach and an additional financial burden to states, the Dallas Morning News reported earlier this month.
