This has already happened at the State and county level with me. I do not have a Birth Certificate. I have been refused a U.S. passport three times. I have an Article 9 Security agreement with my Transmitting utility, i.e.;(strawman). I have a UCC-1 financing statement as a secured party creditor to my strawman along with a Hold Harmless Indemnity agreement filed with the Secretary of State. I also filed an Indemnity Bond with the U.S Treasury Dept. The TIN assigned to my transmitting Utility is a IMF entity account I.D. number (SSN) pursuant to 26 CFR when the dashes are inserted into the number. When the SSN is separated a certain way it is a CUSIP number and can be used to pay public debt. The Tennessee Chancery Court made the Judicial determination that I was not my name in all CAPS and gave the plaintiff a default for failure to appear, but made me, the living man, liable in the final order. I appealed this to the Tennessee Appeals Court and they made a judicial determin
ation that the all CAPS entity and the real man were separate entities and I being a real man and not a corporation or attorney, had no standing to file the appeal for the all CAPS defendant, but they would amend the lower Court ruling to reflect the proper defendant in the final order. The Appeals court made a judicial determination that: I was not the all CAPS entity, not a corporation, not the all CAPS Strawman, did not have an SSN, and was not liable for any debt of the all CAPS strawman. In the Sessions Court I was asked if I was a corporation. I asked how the defendant's name was spelled on the docket. Was it in all caps or was it in upper and lower case? The judge stated it was in all CAPS. I reminded the Court that if it is spelled in all caps it is either an acronym, a shipping vessel in commerce on the high seas or a legal fiction corporation. He then asked if I was an BAR attorney that could represent the corporate defendant. When I responded: No, the judge stated
"If you are not a corporation and not a BAR licensed attorney that can represent the all CAPS corporation, then you have No business in my Courtroom". "And, since the defendant failed to appear by attorney I am granting them a default for failure of the defendant to appear." That is it folks!!! Read the appendix of the Penhallow v. Doane's Administrators case. The Government only has jurisdiction over corporations. They have no jurisdiction over living people. That is why your name on the driver's license is in all caps, and you signed the license as surety for the corporation as a federal employee with an SSN. Only federal employees can have or use the SSN. 20 CFR 422-425. The strawman account is theirs, and you must fill out an IRS form 56 relinquishing fiduciary responsibility over the account to be set free of their corporate tax swindle, and corporate judicial system, and quit using their strawman account number as your own. I believe the reference is in 28 CFR.028. It's been awhile since I have read it so I may be a little off. The Chancery Court and sessions Court ruling you can not find online because it has not been cross recorded. The Tennessee Appeals Court Case is BANK OF AMERICA v. MICHAEL DAROCHA and the opposing counsel wrote the order for the Chancery Court which is very inaccurate to what transpired in the Court as she states that I appeared as two persons. I represented myself as the secured party creditor to the account and not the Corporation and had the paperwork filed to prove it.
