apparently in the Constitution it says the the highest law of the land shall be
the constitution AND the treaties - so that that is where they (think they) get
their justification. Take a look at the fist few articles - don't have them

Thank you. It is often forgotten that the American Constitution was de facto abolished after the Civil War. I am not a lawyer - but it should be obvious that the 14th Amendment "destroyed" most of the State's rights and - especially under Rosevelt later - a multitude of various laws were put like layers over the original law - as e.g. the Uniform Commercial Code (UCC) - in attempts to harmonize the law of sales and other commercial transactions in all states within the United States of America....
And - did Rosevelt get the Senat's concurrence before "his" announcement?
