DAVID IRVING BAIL DENIED BY VIENNESE COURT. WHY?...
British historian David Irving must stay in custody in Vienna while he is charged with denying the Holocaust, a Viennese court ruled today. His lawyer, Elmar Kresbach wanted to bail for the historian an amount of 10 to 20,000 US$ and filed for his client's release from custody. The judge, Peter Seda, dismissed his motion, ruling that there were risks of escape and committing the act again.
Vienna's state prosecutor has charged the 67 years old historian with denying the Holocaust in two lectures he gave in Vienna and Leoben 1989 - as denying the Holocaust is illegal under Austria's law. It may carry sentences from one to 20 years in prison.
Irving has now eleven days to appeal against the ruling while the court will reconsider whether he has to stay in prison. The next scheduled court ruling will be on Dec. 27.
As I reported, Irving was arrested two weeks ago - under a warrant issued in 1989 - after visiting Vienna to speak at a meeting of the student fraternity called Olympia, he told Austrian weekly magazine News this week. When driving to the meeting in Vienna, one of the students noticed plainclothes detectives waiting near the fraternity's house, he said. Irving changed plans and drove to Graz/Styria to visit one of his publishers. The Highway-Police stopped him on the motorway towards the Styrian capital and detained him.

Recently, Austria's Govt. is fighting hard to close a deal about clearing the way for payouts from a 2001 settlement fund to compensate Austrian Jews whose property was confiscated during the Nazi era and World War II.
A federal appeals court has tossed out a class-action lawsuit by Austrian Jewish victims of the Nazi regime in a ruling that may clear the way for payouts from a 2001 settlement fund. In a 2-to-1 ruling Tuesday, the 2nd U.S. Circuit Court of Appeals in New York has declared that it was "particularly mindful" of the federal government's statement that dismissing the case would advance its relations with Austria, Israel and Western, Central and Eastern European nations.
"... The lawsuit was the final case holding up implementation of an agreement with Austria that established a fund to compensate Austrian Jews whose property was confiscated during the Nazi era and World War II, the appeals court said.
Distributions from the Austrian compensation fund, which included $150 million to cover certain property claims, were contingent on dismissal of the case.
The U.S. government had engaged in international negotiations for more than 50 years to settle Nazi-era claims but intensified efforts in 2000, resulting in a 2001 agreement with Austria to establish the fund, the court noted...."
"Hostagetaking" the opposite way? Anyhow, the "timing" of these two events is indeed interesting...
