SOME KIND OF LOGICAL FALLACY IN THERE, SOMEWHERE....

(Hi, FarSight. :) I've listened to intelligent discussions about whether secession was something allowable under the terms of the Constitution. The argument that, "No, it's not allowable," makes sense to me - and yet, there's a logical fallacy present in an idea that it is not.
The country is describable as "a confederation of sovereign States", including provision for a federal government (a service agency intended to operate on behalf of the States).
The idea that the federal government "did not recognize the legality" of secession shouldn't mean diddly-squat, it seems to me. :) It seems an utter irrelevancy, comparable to the infamous "Strawberry Statement" that set off riots at Columbia University in the 1960's. Some college official made a public statement, something like this: "For the students to tell me how they'd like the college to be run is like their telling me that they like strawberries." He was making a valid point in some ways, but not a very wise one. :) And the kids on campus proceeded to demonstrate for his enlightenment just how much their opinions _did_ matter, at least to them.
Who's in charge? That seems to be the underlying and core question. In America, is the feral gummint in charge, or are the States in charge? Are the States in charge, or is it "We the People" who are sovereign in all this? If the people of a particular State clearly are in favor of secession, then who, exactly, is the feral gummint to "recognize" it or not?
