MY ROUGH TRANSLATION

In Response To: 5 REASONS BY A LAWYER WHY NO to EU! (StClair)

Trust a French law professor having to spell it out legally
I translate him, so all USA Canadian Australians UK and Euros may better understand,
but my translation is in the spirit of what he says:

: In the words of the Law Professor Chouard

: 5 bullet points why EU is ILLEGAL in essence NOT LAWFUL.

:

He had initially ten massive reservations against the dangerous text and another ten reasons against the disagreeable (obnoxious) tone of the text, and after much work boiled it down to the 5 reasons against EU constitution or five principle issues that reflect throughout the text he analyzed, these are actually exactly the five criteria for what a constitution worth this name is made for. Protection of Citizens.

: HE CALLS THIS A DANGEROUS TEXT
and he says the media have not allowed a proper debate.

so i add this for the other Europeans to see it early.

In this state business, the foundations of constitutional law are abused. This then leads to remind oneself of the five traditional principles conceived of so as to protect citizens.

a constitution must be legible (readable) to allow a popular vote. This text is illegible.

a constitution does not impose a policy one way or another. This text is partisan.

: 3. Une Constitution est révisable : ce texte-là est
: verrouillé par une exigence de double unanimité.

a constitution is revisable (ammendeable). This text is locked in due to the exigence of a double unanimity.

a constitution protects from tyranny via separation of powers and via control (checks and balances) of the powers. This text does not organize a real check and balance of the powers nor a real separation of powers.

: parties.

a constitution is not edicted by the powerful, it is established by the people itself, precisely in order to protect the people from the arbitraryness of the powerful, via a constituant assembly, independent, elected for this purpose and revoked thereafter. This text implements european institutions which were written fifty years ago by men in power who were both Judge and party.

: This needs careful legal and proper English translation
: anyone volonteer ? ;-)
:

Keep in mind this is from the view point of a French law professor.
